On 21 May 2026, the Law of Ukraine No. 4856-IX “On Amendments to Certain Laws of Ukraine Regarding the Expansion of the Jurisdiction of International Arbitration,” adopted on 28 April 2026 and published on 20 May 2026 in the official newspaper of the Verkhovna Rada of Ukraine, “Holos Ukrainy,” entered into force. Among other things, the Law amends Ukrainian legislation in the field of international commercial arbitration, aiming to bring it in line with the standards of the UNCITRAL Model Law on International Commercial Arbitration relating to: the categories of disputes that may be referred to international commercial arbitration, and the possibility of international commercial arbitration tribunals with a seat in Ukraine to resolve investment disputes.

Following the entry into force of the said Law of Ukraine, the ICAC at the UCCI is preparing a comprehensive review of its selected provisions and is developing a set of activities for its implementation, including the necessary amendments to the Rules of the ICAC at the UCCI.

The adoption of Law No. 4856-IX is an important step towards the development of international arbitration in Ukraine, enhancing Ukraine’s attractiveness as a jurisdiction for resolving international commercial and investment disputes, harmonization of the Ukrainian arbitration legislation with international standards, and expansion of the tools available to protect the interests of domestic and foreign businesses.
