The Presidium of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (ICAC) has adopted the Rules of Conduct for Arbitrators, developed with due regard to generally recognised international standards and recommendations in the field of international arbitration.
The adoption of the Rules is particularly timely as the evolving practice of international arbitration, the digitalisation of arbitral proceedings and the growing use of new technologies present arbitrators with new professional and ethical challenges. At the same time, arbitrator independence and impartiality, appropriate disclosure and confidentiality remain fundamental to parties’ trust in arbitration.
The Rules bring these core requirements together in a single instrument and establish clear standards concerning independence and impartiality, disclosure, confidentiality, diligent performance of arbitral duties, professional communication, and the responsible use of information, communication and digital technologies. Their purpose is to promote fair and efficient arbitral proceedings and to further strengthen confidence in arbitration and the authority of ICAC.
The adoption of the Rules represents an important step in ICAC’s continued implementation of contemporary international arbitration standards and in providing clear and transparent benchmarks for the professional conduct of arbitrators.
