On 15 September 2026, the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (the ICAC) and the state institution “Investment Promotion Office” (UkraineInvest) signed a Memorandum of Cooperation.

The Memorandum establishes systematic cooperation between the ICAC and UkraineInvest in providing investors with informational and expert support, promoting international arbitration and mediation as effective mechanisms for resolving commercial and investment disputes, and raising awareness on efficient tools for protecting investors’ rights in Ukraine.
The cooperation is particularly relevant following the expansion of the jurisdiction of international commercial arbitration in Ukraine, including the ICAC’s authority to hear investment disputes. For potential and current investors, it is important not only to have access to appropriate dispute resolution mechanisms, but also to receive clear and comprehensive information about the possibilities for using them, the ICAC’s jurisdiction, the procedure for submitting a case to the arbitral institution, and the specific features of resolving commercial and investment disputes.

The ICAC President Mykola Selivon emphasized that expanding the opportunities for international commercial arbitration in Ukraine urged investors to be properly informed about the available mechanisms for protecting their rights:
“It is important for an investor to understand that Ukraine has clear, modern and internationally recognized mechanisms for protecting their rights and legitimate interests. Cooperation between the ICAC and UkraineInvest will help strengthen the provision of information to investors and will also contribute to increasing confidence in Ukraine as a jurisdiction for doing business.”

The Executive Director of UkraineInvest Marina Khlystun noted that access to effective dispute resolution mechanisms was an important component of Ukraine’s investment ecosystem:
“When deciding whether to enter the Ukrainian market, it is important for an investor to clearly understand which mechanisms they can use to protect their rights in the event of a dispute. We are interested in ensuring that potential and existing investors receive practical and accessible information about the opportunities for international arbitration and mediation in Ukraine. Cooperation with the ICAC is an important step in this direction.”
The Memorandum provides for cooperation in several key areas, including informational support for investors, joint communication activities, expert cooperation, educational and awareness-raising activities, as well as informational support for the ICAC’s activities.
A separate area of cooperation will focus on educational and awareness-raising activities aimed at increasing UkraineInvest staff’s understanding of the ICAC’s jurisdiction, the procedure for submitting disputes to the ICAC, and the advantages of international arbitration and mediation.
Under the Memorandum, UkraineInvest will also facilitate the dissemination of information about the ICAC’s activities and jurisdiction through its own information resources and communication channels.

The implementation of the Memorandum is expected to strengthen institutional capacity in the area of investor support, increase businesses’ awareness of the opportunities offered by international arbitration and mediation, and enhance confidence in Ukraine as a jurisdiction where investors have access to modern and effective dispute resolution mechanisms and means of protecting their rights.
