“From Reform to Trust: Expanding the Scope of International Commercial Arbitration and Establishing Ukraine as a Venue for Resolving Investment Disputes”
In this article, contributed exclusively to *Yurydychna Praktyka*, Mykola Selivon, the President of the International Commercial Arbitration Court (the ICAC) and the Maritime Arbitration Commission (the UMAC) at the Ukrainian Chamber of Commerce and Industry, and Volodymyr Nahnybida, the Vice President of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry, analyze the potential impact of the Law of Ukraine No. 4856-IX on the development of international arbitration in Ukraine. The law does not only bring Ukrainian arbitration legislation in line with modern international standards but also, for the first time in history, establishes the possibility for international commercial arbitration tribunals to hear investment disputes with the seat of arbitration in Ukraine.
The authors examine key legislative changes, their impact on the development of the arbitration system and judicial practice, and assess the prospects for Ukraine as a modern pro-arbitration jurisdiction and a venue for resolving international commercial and investment disputes.
