Mykola Selivon, the President of the ICAC, and Yuriy Prytyka, the Vice President of the ICAC, took part in the Roundtable “Justice of the Future: Alternative Dispute Resolution” co-organized by the Yurydychna Praktyka Publishing House and the ICAC with the support of the Supreme Court.
The roundtable discussed the role and development of alternative dispute resolution in Ukraine, in particular in the context of investment disputes, intellectual property and insolvency disputes.
The event was moderated by Mykola Selivon, the President of the ICAC, and Oleksiy Kot, Director of the Institute of Law-Making and Scientific-Legal Expertise of the National Academy of Sciences of Ukraine. The ICAC President, in particular, noted that the main alternative dispute resolution (ADR) methods – arbitration, arbitration tribunals and mediation – have become an element of the global legal order. ARD is also of great social and political importance, since an individual or legal entity can independently determine the method of protection of their rights and interests – state justice or a non-state method of dispute resolution. Promotion of democracy in any society is the main purpose of alternative dispute resolution.
Yuriy Prytyka focused on the arbitrability of disputes in Ukraine. Mr. Prytyka drew the attention of the roundtable participants to the main criteria of disputes arbitrability referring to the Ukrainian legislation. Commenting on the general challenges of arbitrability, Yuriy Prytyka raised the need to amend the Ukrainian legislation in the field of arbitrability, in particular, to expand the concept of “international dispute”, the list of arbitrable disputes and to expand the subjective criteria of arbitrability to include individuals. In his presentation, Yuriy Prytyka focused on the definition of arbitrability of corporate, bankruptcy and public procurement disputes.
The event confirmed the importance of developing alternative dispute resolution methods and once again demonstrated the need for further improvement of arbitration legislation and strengthening the position of Ukraine as a seat of arbitration.
