From 28 June till 16 July the 54th session of the United Nations Commission on International Trade Law (UNCITRAL) takes place in a hybrid format in the Vienna International Center and online. Ukraine is represented by ICAC’s Vice President Inna Yemelianova.
The 54th session of the Commission is tasked with developing documents, guides and provisions relating to expedited arbitration, mediation in commercial disputes and simplified insolvency regime.
The texts to be developed by the 54th session of the Commission are aimed not only at addressing the practical international trade issues arisen from the pandemic restrictions in 2020-2021, but also at outlining the future of international trade and alternative dispute resolution for years to come.
The delegates of the 54th session considered the following documents, earlier developed by the relevant Commission working groups:
- Draft UNCITRAL provisions on expedited arbitration;
- Draft UNCITRAL explanatory note to the provisions on expedited arbitration;
- UNCITRAL commercial disputes mediation rules;
- UNCITRAL comments on mediation texts;
- Guidelines on the adoption and application of the UNCITRAL model law on international commercial mediation and international amicable settlement agreements reached in the result of mediation (2018).
The contribution of ICAC’s representatives to the work of the Commission signals of a significant level of trust to the ICAC globally, and Ukraine’s progressive and proactive attitude towards the development and implementation of international best practices of alternative dispute resolution.
It is woth noting that the ICAC Rules contain a separate article, regulating the peculiarities of the expedited arbitration proceedings. The UNCITRAL texts on expedited arbitration developed at the 54th session of the Commission would become solid grounds for further consideration and improvement of the current ICAC Rules. Moreover, ICAC’s strategic plans for the current year are the introduction of mediation and other hybrid alternative dispute resolution proceedings for the resolution of commercial disputes in Ukraine following the adoption of the Law of Ukraine “On Mediation”. Ukraine’s contribution to the development of the relevant international regulations bring us closer to effective implementation of mediation in commercial disputes in Ukraine.
