On 11 June 2026, Volodymyr Nahnybida, the Vice President of the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (ICAC Ukraine), participated in the 10th International Forum “Mediation and Law”, jointly organised by the Ukrainian Academy of Mediation and the European Commission for the Efficiency of Justice (CEPEJ), with the financial support of the European Union within the framework of the EU Project “CONSENT”.
As part of the Forum, an international panel discussion entitled “The Ecosystem of Trust: Mechanisms for Resolving Investment Disputes” was held, moderated by Nataliia Danylko, member of the Ukrainian Academy of Mediation, PhD in Law and accredited mediator.
The panel brought together distinguished international experts in the fields of investment arbitration, mediation and international investment law, including Emad Hussein (UAE), Oleg Shaulko (United Kingdom), Fidana Alieva (Kyrgyz Republic) and Leah Njoroge (ICSID, World Bank Group).
In his presentation, Volodymyr Nahnybida outlined his vision for the further development of Ukraine as a modern jurisdiction for international commercial and investment arbitration. Particular attention was devoted to the recent legislative reforms in the field of arbitration, which have created new opportunities for the resolution of international investment disputes with a seat in Ukraine and opened additional prospects for the development of the country’s international arbitration framework.
The speaker emphasised that building investors’ trust requires not only an appropriate legal and regulatory framework, but also the consistent development of the entire dispute resolution infrastructure. In this context, he presented the concept of an “ecosystem of trust”, which envisages the comprehensive development of interconnected elements necessary for the effective functioning of international investment arbitration.
Among the key components of such an ecosystem, he highlighted modern arbitration legislation, effective and predictable judicial support for arbitration, the activities of professional arbitral institutions, a high level of expertise among arbitrators, legal counsel and experts, as well as a consistent state policy aimed at supporting arbitration and other alternative dispute resolution mechanisms.
Special attention was also paid to the role of arbitral institutions as centres of trust capable of ensuring efficient case administration, high-quality procedures and access to international expertise. To illustrate Ukraine’s institutional capacity, selected statistics relating to the activities of ICAC Ukraine were presented, demonstrating the steady growth of international confidence in the Ukrainian arbitral institution.
In concluding his remarks, Volodymyr Nahnybida noted that the development of Ukraine as a seat for international investment arbitration is the result not only of legislative reforms, but also of the consistent construction of an environment of trust in which the state, the judiciary, arbitral institutions and the professional community work together to create predictable and reliable conditions for investors and businesses.
