The ICAC cases are considered by arbitrators appointed from the ICAC Recommendatory List of Arbitrators by the parties or the President of the Ukrainian Chamber of Commerce and Industry (the UCCI).

According to Article 6(2) of the ICAC Rules, the Presidium of the UCCI shall approve, on the proposal of the ICAC Presidium, the Recommendatory List of the ICAC Arbitrators, for a period of five years, which can include nationals of Ukraine, as well as nationals of other states and persons of no nationality, possessing the requisite specialized knowledge in the field of disputes’ settlement within the jurisdiction of the ICAC and meeting high moral and ethical requirements.

Applicants interested in inclusion into the ICAC Recommendatory List of Arbitrators, shall submit to the ICAC Secretariat the following documents:

• a motivation letter, highlighting the key reasons, why the applicant believes he\she should be included into the ICAC Recommendatory List of Arbitrators;
• a detailed Curriculum Vitae;
• a completed Applicant’s Questionnaire;
• a portrait photo in .jpeg or .png.

The above documents will further be considered by the ICAC Presidium in the process of compiling a renewed Recommendatory List of Arbitrators. The ICAC Presidium examines each individual candidacy regarding the applicant’s compliance with the stated requirements and decides on the inclusion of the applicant into the list of persons recommended as arbitrators and submits said list for approval to the UCCI Presidium. The list of applicants who are recommended for inclusion into the Recommendatory List of Arbitrators as well as the list of applicants who do not receive the recommendation for inclusion are drawn up by the respective Decision of the ICAC Presidium. Each applicant will be notified via e-mail about the Decision of the ICAC Presidium.

A person who wishes to become an ICAC arbitrator must meet the following requirements:

• at least 10 years of experience in resolving disputes within the jurisdiction of the ICAC, practical experience in the field of law or academic research;
• higher professional education corresponding to the field of the applicant’s expertise;
• aged 30 – 80 years old;
• adherence to high moral and ethical standards.

Professional awards, endowments or distinctions that highlight the applicant’s leadership in the field of international arbitration, experience in resolving disputes as an arbitrator at other international arbitration institutions, individual professional rankings in the field of international arbitration by reputable international rankings will be an additional benefit.

The ICAC Recommendatory List of Arbitrators is renewed every five years. The applications received during the validity of the current Recommendatory List of Arbitrators, are reviewed by the ICAC Presidium only when the renewed Recommendatory List of Arbitrators is compiled.

While compiling the renewed Recommendatory List of Arbitrators in 2023 the ICAC Presidium intends to expand the List, in particular, to broaden the geography of arbitrators, attract arbitrators experienced in resolving investment disputes, disputes in the areas of IT, e-commerce, construction. In addition, responding to multiple users’ requests, the pool of arbitrators qualified to resolve English-law governed cases will be expanded. The renewed Recommendatory List of Arbitrators to be approved by the UCCI Presidium in late 2023, will remain valid for the next 5 years.
